What To Do When So
Much of the Constitution
Recently, while giving one of the final lectures in my new "Constitution As The Founders Understood It" class, I was fortunate enough to have some great feedback from some very knowledgeable people. Once again, I saw that all-too-familiar look on their faces telling me that they'd never realized just how far we have strayed from what our founders intended. The sheer volume of changes, specifically to what was intended in Article 1 of the Constitution, regarding the legislative branch, is mind-boggling to say the least.
To explain the difference between this class and most other Constitution classes, is usually a difficult thing for me to do. I have many students that have taken other Constitution courses, including the highly acclaimed Hillsdale College course, and then send emails to me commenting on the further depth I give to the training than they have received elsewhere.
I believe that the best explanation for the difference came this week from a lady currently taking this class. I will paraphrase her as best as I can.
"Most Constitution courses start with the premise that the Constitution was perfect. They don't teach the areas where there were conflicts between ideologies and those conflicts resulted in flaws within the Constitution that have been exploited..."
This observation is likely better having come from one actually attending my class. I definitely drill-down into the fundamental principles, the clashes between those who truly sought individual sovereignty and a level of freedom unheard of in the world at that time and those who really leaned more towards a "softer" version of the monarchies and aristocracies most American colonists had just fled from.
I also teach where revisionist history has taught us some blatantly false ideas about the Constitution and especially the requirement, by so many, that the Bill of Rights be added and how that very fact scared the drafters of the Constitution so badly that they were afraid of a 2nd Constitutional Convention completely eradicating the Constitution. I also teach about the 2-year debates over the 9th Amendment in the Virginia ratifying convention. This simple focus should tell us just how important the 9th Amendment was to our founders and highlights the fact that very few of those "unenumerated rights" in the 9th Amendment have ever been addressed as we would probably be MUCH closer to living the level of liberty our founders intended.
